Terms and Conditions of Entry for the Win an Epic Surf Trip Promotion (Promotion)
1. These terms and condition of entry, including information on how to participate and prize details (Terms), apply to the Promotion and entry into the Promotion is deemed acceptance of these Terms.
2. The Promoter is GOOD2EPIC Pty Ltd t/a EPIC SURF TRIP (A.C.N. 155 473 724) of 68/1 Warbler Parade,Varsity Lakes, QLD 4227 (Promoter)
3. The Promotion will be open from 12:01am AEDST on 2 May 2012 until 11:59pm AEDST on 31 August 2013.
4. Entry in the Promotion is only open to persons aged 18 years and over, excluding:
(a) management, employees, directors and contractors of the Promoter, its related entities of EPIC SURF TRIP, firms or companies associated with the Promotion (including suppliers of prizes);
(b) a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 5(a) of these Terms;
(c) persons who have used or attempted to use any more than one name in order to qualify to win a promotion previously run by or on behalf of the Promoter (except in the case of a legal change of name); and
(d) persons who have breached the terms and conditions of any promotion previously run by or on behalf of the Promoter
(Eligible Entrants). The persons referred to in paragraph 5(b) of these Terms includes natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion.
HOW TO ENTER
5. To be eligible to win, Eligible Entrants must, during the Promotion Period:
(a) Register as a member on www.epicsurftrip.com, add a business and rate and review it, or rate and review an existing business, in accordance with the EPIC SURF TRIP Upload Terms.
6. Once registered with EPIC SURF TRIP an Eligible Entrant will be granted one (1) entry into the prize draw for each business that is rated and reviewed in full by the entrant.
7. Eligible Entrants can complete their Eligible Entry during the Promotion Period via WEB by:
a. Visiting www.epicsurftrip.com/competition and following the links to the Promotion entry page (Online Entry Site);
i. indicating their acceptance of these Terms, (Web Entry).
NB. This indicates express consent to be added to the EPIC SURF TRIP database.
PRIZE DRAW
8. The first Eligible Entrant with a valid Eligible Entry drawn will win a surf trip, valued at up to AUD$5,000 (including GST) (RRP) (Prize). The promoter will choose the destination of the surf trip based on the geographical location of the Eligible Entrant.
The destinations are as follow but not limited to –

Bali, Indonesia

Oaxaca, Mexico
-
Hossegor, France
-
Jeffreys Bay, South Africa
9. The Prize comprises of:
(i) Return economy airfares for two (2) adults from the airport in the capital city nearest to the winner's residence to the destination as decided by the Promoter, including all airline and airport taxes, flying on an airline of the Promoter's choice; and
(ii) A surf trip selected by the promoter from one of the destination options in paragraph 8 (at the discretion of the Promoter).
10. Each surf trip includes accommodation and meals depending on the provider (at the discretion of the Promoter).
11. The winner and companion may extend their trip at their own expense. They will be required to liaise with nominated the travel agent when booking their travels. The Promoter is in no way responsible for any additional costs incurred including flight changes.
12. Draw winners will be notified by e-mail and/or in writing within two (2) business days of the draw.
13. All costs associated or arising in connection with the Prize are the responsibility of the Prize winner.
14. All travel is subject to nominated travel agents conditions as set out below:

Valid identification, additional spending money, passport, meals (other than those included) and any other ancillary costs, including but not limited to insurance and any applicable insurance excesses, not listed in the Prize descriptions above are the responsibility of the Prize winner and his/her nominated traveling companion as incurred. It is the winner's responsibility to organize transport to/from the airport departure/return point in his/her country of residence.
16. Prize winners must hold a valid credit card and present it at the accommodation to cover any incidental charges they include during their stay.
17. Terms are subject to change at the Promoter’s absolute discretion, including, but not limited to, due to a change in a location’s security classification, natural disaster or other acts of God, subject to written directions from State Regulatory bodies. The Promoter may make these changes at any time prior to the Prize winner and their nominated travel companion departing on their trip, subject to written directions from State Regulatory bodies.
18. Penalties may apply for re-booking, amending, extending or cancelling travel and/or Accommodation, and the responsibility or winners and/or their nominated travel companion as the case may be.
19. All components of the Prize must be taken together in a single trip and cannot be redeemed separately.
20. Any components of the Prize not used by the winner or their nominated travel companion is forfeited and the Promoter is not obliged to provide the winner or their nominated travel companion with the cash equivalent of or any substitute for any Prize component in those circumstances.
21. It is the responsibility of Prize winner and their nominated travel companion to ensure they have obtained all relevant visas and vaccinations, and comply with all other requirements, for travel to their chosen destination. The Promoter takes no responsibility for forfeiture of travel as a result of a failure to meet such requirements.
22. Acceptance and use of the Prize by the winner and their nominated travel companion is subject to the winner and their nominated travel companion:
(a) obtaining travel insurance for the duration of their participation in the Prize an amount and from an insurer acceptable to the Promoter; and
(b) agreeing not to act or fail to act in a manner which brings or may in the Promoter's opinion bring the Promoter or its related entities into disrepute, during the course of their participation in the Prize.
23. If the Prize is won and the Eligible Entrant does not claim their prize by 11:00am AEST on 20 September 2013, due to the nature of the Prize and its travel/booking requirements, a random electronic re-draw will be conducted on that date at 12:00pm AEST at the Draw Location by one of its representatives from all remaining Eligible Entries received in the Promotion, subject to any directions from State and/or Territory Gaming (Re-Draw).
24. The Re-Draw Prize winner, if any, will be notified by e-mail and/or in writing
25. The total Prize Pool value is up to AUD$5,000 (Five Thousand Australian Dollars) ,including GST.
VERIFICATION
26. If requested by the Promoter, the provisional Prize winner must produce, within the time requested by the Promoter at its absolute discretion:
(a) appropriate photo identification or other documentation, required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim the Prize and compliance with these Terms; and
(b) request that he/she log on to the EPIC SURF TRIP website using their log in details as proof of being a registered member.
before the Promoter issues their Prize. If the items required by the Promoter are not received or a provisional winning entry has not been verified to the satisfaction of the Promoter within the time period required by the Promoter, the provisional winner's entry will be invalid and, at the Promoter's absolute discretion, all of the provisional winner's remaining entries will be invalid. Prizes will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction.
27. If more than one person attempts to claim a Prize, the Promoter has sole and absolute discretion to determine which of those persons is the winning Eligible Entrant.
GENERAL
28. Each review added which must be verified and approved in full, counts towards one entry only.
29. Each Eligible Entry must be:
(a) based on a separate rated and reviewed listing; and
(b) submitted separately in accordance with these Terms.
30. In order to claim and/or participate in the Prize, the Prize winner is required to sign a Promotion Participation Agreement on terms determined by the Promoter, including:
(a) confirming their eligibility to enter the Promotion and compliance with these Terms; and
(b) providing a release and indemnity in favor of the Promoter in respect of their participation in the Promotion and acceptance and use of their Prize.
31. Prizes are not transferable, exchangeable or redeemable for cash. Prizes must be taken as offered and may not be varied.
32. The Promoter accepts no responsibility for any variation in the value of the Prizes.
33. If the Promoter is unable to provide the winner with the nominated Prize, the Promoter reserves the right to supply an alternative prize of equal monetary value to the nominated prize, subject to any directions given by State and/or Territory Gaming Departments.
34. If the Promoter is unable to provide the nominated prize for any reason, the promotion will run until such time the Promoter is able to provide the nominated prize, subject to any directions given by State and/or Territory gaming Departments.
35. The Promoter reserves the right to extend the the Promotion Period to a later date.
36. The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period.
37. If, for any reason, the Promotion is not capable of being run as planned, including due to infection by infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to State and Territory regulations, including cancelling, terminating, modifying or suspending the Promotion.
38. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism or Draw in any way, engages in any unlawful or improper conduct which jeopardizes or is likely to jeopardies the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.
39. Incomplete, illegible, indecipherable or incorrect entries are not eligible to win.
40. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms. The Promoters decisions in relation to all aspects of the Promotion are final and binding on each entrant and no correspondence will be entered into.
41. The Promoter collects personal information about entrants to include entrants in the Promotion and where appropriate award the Prize. If the personal information requested is not provided, the entrant cannot participate in the Promotion. By participating in the Promotion, each Eligible Entrant consents to the Promoter using, and disclosing their personal information to the Promoter's related entities, the Promoter's agencies and other third parties engaged to provide services in connection with the Promotion including suppliers of Prize for use for, the following purposes:
(a) contacting the entrant in relation to the Promotion;
(b) improving the Promoter's or the Promoter's related entities' goods and services;
(c) the purposes set out in the Promoter's privacy policy at www.epicsurftrip.com/privacy; and
(d) The Eligible Entrant provides this consent until such a time as they withdraw their consent by giving notice to the Promoter. Eligible Entrants can also gain access to, update or correct any personal information held by the Promoter where all personal information will be stored.
42. By entering the Promotion, entrants agree and acknowledge:
(a) they may be contacted by the Promoter (or an agent of the Promoter) to provide comments about the Promotion and the Promoter (or an agent of the Promoter) may take photos or recordings of them;
(b) the Promoter may use any comments obtained from them, their name, and/or likeness and any photos or recordings taken of them (the Materials) for the Promoter's future promotional and marketing purposes without further reference or compensation to them;
(c) the Promoter may duplicate, alter, adapt and utilize the Materials as the Promoter wishes at anytime, anywhere, and by any means (including communicating them to the public in any media, including media not yet in existence). The Promoter may license, authorize or otherwise transfer the rights in the Materials to others to do the same;
(d) they grant to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable license to use the Materials for whatever purpose it determines;
(e) they unconditionally and irrevocably:
(i) consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given (Moral Rights); and
(ii) waive all Moral Rights in the Materials that arise outside Australia; and
(f) they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.
43. By entering this competition and providing their email address, Eligible Entrants agree to be contacted by EPIC SURF TRIP for promotional purposes.
44. The:
(a) Promoter, the Promoter's related entities, the Participating Outlets, and all agencies associated with the Promotion; and
(b) the employees, agents, directors and contractors and anyone working on the promoter’s behalf.
(c) shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of, or participation in, the Prizes, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).
45. The Promoter accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of the Prize.
46. Eligible Entrants agree and acknowledge that all entries and any intellectual property rights subsisting in their entries become and remain the property of the Promoter.

This agreement (Agreement) is between you and Good2Epic Pty Ltd A.C.N 155 473 724 trading as Epic Surf Trip (we, us, our or EPIC SURF TRIP).
General terms
This Agreement governs the content that you provide to EPIC SURF TRIP when uploading, posting, sharing, submitting, sending, publishing and/or making available via the website displayed at www.epicsurftrip.com (the Website), including all comments, photos, illustrations, video clips, sound clips and any other media (Content).
We may at any time and at our sole discretion, amend, revise or modify this Agreement. Although we may notify you of any amendment, revision or modification, it is your responsibility to periodically review this Agreement. You agree to be bound by such changes, modifications or revisions as made by us from time to time.
By agreeing to these terms you also agree to the EPIC SURF TRIP Terms of Use.
EPIC SURF TRIP account
In order to upload Content, you are required to create a EPIC SURF TRIP account (Account). When creating the Account, you must provide accurate and complete information. You are solely responsible for all activity relating to the Account. You must not use another person’s Account without permission from the owner of that Account, and you must notify us if you are aware of any unauthorised access to your Account.
By creating the Account and registering as a user of the Website you agree to:
-
accept this Agreement either for yourself or on behalf of another person or entity; and
-
be bound by the terms and conditions contained in this Agreement.
Content
You are solely responsible for all Content that you upload via your Account and for any consequence of uploading that Content. We do not guarantee any confidentiality with respect to any Content that you upload via your Account.
You agree that you will not upload Content that:
-
contains third party copyrighted material, or material that is subject to other third party proprietary rights, unless you are the owner of that material or have permission from the rightful owner of the material or you are otherwise legally entitled to upload the Content and to grant EPIC SURF TRIP all of the licence rights granted herein;
-
contains falsehoods of misrepresentations;
-
is unlawful, threatening, harassing, hateful, facilitates or encourages conduct that could be considered a criminal offence, gives rise to a civil liability, violates any law, or is otherwise inappropriate in the view of EPIC SURF TRIP;
-
impersonates another person; or
-
contains adult-oriented and/or explicit material;
-
where content is not for a approved business listing i.e. reviews - contains personal information such as names, mailing adresses, phone numbers or e-mail addresses;
-
where content is not for a approved business listing i.e. reviews - contains spam/advertisments or are clearly commercial in nature (reviews);
You authorise EPIC SURF TRIP to create algorithms based on the Content for the purposes of:
-
hosting the Content on servers owned or controlled by EPIC SURF TRIP;
-
indexing the Content; and
-
displaying, performing or distributing the Content, in whole or in part.
EPIC SURF TRIP reserves the right to edit Content that does not comply with this Agreement.
EPIC SURF TRIP reserves the right to remove from the Website any Content for any reason whatsoever. The removal of Content from the Website may occur without any liability to EPIC SURF TRIP.
Licence
EPIC SURF TRIP may seek your approval for a worldwide non-exclusive, sub-licensable, royalty-free licence, and with your explicit written approval:
-
use, reproduce, distribute, display, publish and adapt part or all of the Content;
-
publicly promote, endorse or market the Content in any way whatsoever, including via the Website or otherwise;
-
perform or carry out any actions associated with achieving any of the above.
EPIC SURF TRIP may use the Content for any period of time beyond your removal of the Content from the website.
Warranties and representations
You warrant and represent to EPIC SURF TRIP that:
-
you have authority to enter in to this Agreement;
-
you are authorised to upload the Content to the Website;
-
you solely own the Content and you have obtained all necessary rights, clearances, waivers and consents relating to the Content;
-
you are not aware of any pending or ongoing litigation relating to the Content, or any part of it;
-
the Content that you upload to the Website is original and is not a reproduction, whether in whole or in part, of another person’s work; and
-
the Content does not contain any viruses, trojans, worms or any other destructive code or content.
Indemnity
In accepting the terms of this Agreement, you agree to indemnify EPIC SURF TRIP and keep EPIC SURF TRIP fully indemnified against all proceedings, claims, actions, damages, costs, losses or harm suffered by EPIC SURF TRIP as a consequence of any breach or non-performance by you of any of the representations or warranties contained in this Agreement.
Acceptance of submissions
EPIC SURF TRIP is in no way obliged to accept or publish any Content uploaded by you via your Account.
Termination of account
We reserve the right to immediately terminate the Account if you are in breach of this Agreement. Such termination may occur at our sole discretion and without notice to you. If we do decide to terminate the Account, you agree to hold harmless EPIC SURF TRIP and its related entities.
Governing law
The laws of the state of Queensland, Australia govern this Agreement.
